Buchanan strives to provide accurate, reliable freight transportation, rigging, and logistics services as described on our website (services are unrelated to services provided by Buchanan Logistics, Inc. unless otherwise contracted to do so as a separate service provider).
However, you acknowledge and agree that:
- Freight transport inherently involves risks (e.g., delays, accidents, mechanical failure, weather, permit refusals, regulatory delays).
- Specialized, oversized, heavy-haul, or HazMat shipments carry elevated risk due to regulatory, environmental, and load-securement factors.
- Time estimates, delivery dates, transit times, and cost quotes are estimates only, based on information available at time of quote. Actual costs and delivery times may vary due to changes in cargo details, route availability, permit issuance, regulatory restrictions, delays beyond our control (e.g., traffic, weather), or force majeure.
- Buchanan does not guarantee delivery times, transit durations, or absence of delays.
Commitments & Customer Responsibilities
You must provide complete, accurate, and up-to-date information about cargo (dimensions, weight, value, classification, HazMat documentation if applicable), origin and destination addresses, required delivery date or windows, and any special requirements (e.g., escort vehicles, permits, loading/unloading, site access). You must secure and provide any special permits or regulatory documentation required for oversize or HazMat loads, unless otherwise agreed in writing; Buchanan may assist in the application process but cannot guarantee permit issuance. You must ensure freight is properly packaged, labeled, and secured for transport, in compliance with applicable laws/regulations.
Limitation of Liability
To the fullest extent permitted by law, Buchanan’s liability for any loss, damage, delay, or failure to perform is strictly limited to the lesser of (a) the amount of damage proven, or (b) the insurance coverage limits applicable for that load, as specified in the rate quote or agreement. In no event shall Buchanan be liable for indirect, incidental, punitive, special or consequential damages (such as loss of profits, business interruption, or loss of use), even if advised of the possibility of such damages.
No Warranty
All services are provided “as is” and “as available.” Buchanan disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Force Majeure
Buchanan shall not be liable for failing to perform or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, weather, traffic conditions, regulatory or permit delays, acts of government, strikes, labor disputes, accidents, or inability to secure necessary escort or routing approvals.
Quotes & Estimates
All quotes and estimates provided by Buchanan are preliminary and non-binding unless confirmed in writing. They are based on information provided at the time of submission (cargo details, dimensions, weight, origin/destination, timing, regulatory needs). Any change in those parameters may require a revised quote.
Insurance & Additional Coverage
While Buchanan maintains cargo and liability insurance for each load, coverage limits are specified in each agreement. If you require higher-valued freight coverage, you must request additional insurance in writing before shipment; otherwise, Buchanan’s standard liability limits apply and we disclaim any responsibility beyond those limits.
Use at Your Own Risk
By contracting with Buchanan, you acknowledge the inherent risks of freight transport and agree to accept these risks. Buchanan’s services and website content do not constitute a guarantee of safe or timely delivery.
