1. Acceptance of Terms
By using Buchanan’s website (www.buchananhauling.com) or submitting a rate quote request or otherwise engaging our services (dry van, flatbed, expedited, specialized, heavy haul, 3PL managed logistics, etc.), you agree to comply with and be bound by these Terms of Service. If you do not agree, you should not use our website or request services.
2. Services
Buchanan provides freight transportation and logistics services, including but not limited to dry van and flatbed trucking, expedited freight, specialized freight (including HazMat and over-dimensional loads), heavy-haul transport, and 3PL managed logistics (services are unrelated to services provided by Buchanan Logistics, Inc. unless otherwise contracted to do so as a separate service provider).
3. Quotations and Acceptance
Any rate quote, estimate, or service proposal we provide is valid for the period specified (or, if none specified, for 30 days from issuance). Quotes are subject to change if shipment details (e.g., dimensions, weight, routing, permits, urgency, regulatory compliance) change. Acceptance of a quote must be confirmed in writing or an agreed-upon electronic format. Failure to confirm may result in refusal or modification of service.
4. Licenses, Permits, Compliance
For specialized or heavy-haul shipments, compliance with applicable laws, permits, escort requirements, and regulations (federal, state, local) is required. The customer must provide accurate information about cargo classification, dimensions, weight, special requirements (e.g., HazMat documentation). Buchanan will use reasonable efforts to secure required permits and escort services, but cannot guarantee issuance of permits by regulatory authorities or guarantee travel times or routing outside our control.
5. Payment Terms
Invoices are payable as specified on the rate quote or service agreement. If payment terms are not specified, payment is due upon receipt of invoice. Late payments may be subject to interest or suspension of services.
6. Liability & Insurance
Buchanan maintains cargo insurance and general liability coverage as appropriate for each load, up to the limits disclosed in the quote or prior agreement. Our liability for loss, damage, or delay is limited to the amount covered by our insurance, except where otherwise required by law. Buchanan is not liable for indirect, incidental, or consequential damages (e.g., lost profits, business interruption). For HazMat, specialized, or heavy-haul loads, certain risks (e.g., delays due to permitting, weather, escort availability) are outside our control; by engaging Buchanan, you accept those inherent risks.
7. Indemnification
You agree to indemnify, defend, and hold harmless Buchanan, its officers, directors, employees, agents, and subcontractors from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from inaccurate or incomplete information you provide, improper packaging or labeling of freight, prohibited cargo, or failure to comply with applicable law.
8. Termination
Buchanan may terminate a service agreement or decline to provide services if you breach these Terms, fail to pay amounts due, provide false or incomplete information, or fail to obtain required permits.
9. Website Use & Intellectual Property
All content on www.buchananhauling.com (text, graphics, logos) is the property of Buchanan. You may view, download, or print pages for your own non-commercial use only. Any other use (reproduction, modification, republication) is prohibited without written consent.
10. Changes to Terms
We may update these Terms of Service from time to time; revised terms become effective as of the “Last Updated” date. Continued use of our website or services after changes constitutes acceptance of the new terms.
11. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles. Any dispute arising under or related to these Terms or the services provided shall be resolved in the state or federal courts located in Allen County, Indiana, unless otherwise agreed in writing.
